West Carthage sued over dump truck accident

WEST CARTHAGE — The village faces a lawsuit over injuries that two town of Martinsburg youths allegedly suffered in a 2011 collision with a village dump truck.

Bonnie L. Kaiser filed state Supreme Court action Friday at the Jefferson County clerk’s office on behalf of her grandchildren Shane A. Gladle and Shania M. Pierce, against the village; the operator of the dump truck, Adam J. Smith, and the driver of a pickup truck that collided with the village’s vehicle, Lori B. Gladle, Lowville, Mrs. Kaiser’s daughter and mother of the injured children.

It is claimed that Mrs. Gladle was northbound on Route 26 in the town of Champion on July 13, 2011, with the youths as passengers. Mr. Smith was driving in front of her when he allegedly signaled a right turn, appearing to be making a turn from Route 26 onto Jackson Road. Mrs. Gladle pulled to her left in an attempt to pass the dump truck, but it is claimed that Mr. Smith instead turned left toward a sand and gravel road, causing a collision that resulted in Mrs. Gladle’s vehicle skidding off the road and slamming into a utility pole.

According to the suit, both youths suffered severe and permanent injuries, including “significant disfigurement” and “permanent consequential limitation of use of a body organ or member.” Miss Pierce also suffered a broken nose.

It is claimed that Mr. Smith and Mrs. Gladle were negligent for, among other things, failing to stay in their lanes and failing to maintain control of their vehicles. It is alleged the village is culpable for the accident as the owner of the dump truck.

The suit does not specify an amount sought in damages. The youths are represented by Syracuse attorney Joseph P. Stanley.
