The deadline for Assemblyman Marc W. Butlers treasurer to file the 27-day post general election campaign finance report with the state Board of Elections passed on Dec. 3 without any action.
Mr. Butler, R-Newport, said the matter should be resolved soon.
Mr. Butler said his treasurer, Pat Reuter, did have the report prepared but wasnt able to file because of a computer error.
She mailed it to [the Board of Elections] on Monday, said Mr. Butler. They should have had it.
Board of Elections Public Information Director John W. Conklin said that a letter will be sent to the treasurer on Dec. 11 if they have still not received the report.
Then the candidate gets a letter the day after that, said Mr. Conklin.
If the treasurer still fails to file the campaign finance report by the second week of January, she will face a $100 penalty.
If the matter is unresolved by February a $1,000 fine will be levied.
Mr. Conklin said that the treasurer may personally be fined $10,000 if she fails to comply for three consecutive filings in an election cycle.
However, Mr. Conklin said, its still early enough that the treasurer may file within the allotted time.
Prior to the election, Mr. Butlers campaign raised $21,350.62, spent $20,516.29, and had $834.33 in reserves.
Mr. Butlers opponent, Democrat Joseph Chilelli of Herkimer, raised a total of $4,410, spent $4,509.77 and had a negative balance of $99.77 on Dec. 3.
