Jefferson County Deputy Sheriff Adam B. Hallett was charged Wednesday by his sheriff with having an open alcoholic beverage container in his vehicle, and is ordered to appear in town of Henderson Court.

Sheriff John P. Burns lodged the charge following his investigation into an incident the evening of Dec. 1 on County Route 72 in the town of Henderson.

The sheriff previously had said he expected to file a more serious charge, but on Tuesday said his investigation failed to substantiate another charge.

Deputy Hallett also will face departmental internal disciplinary charges, the sheriff said, and is being suspended without pay “effective immediately.” He declined comment about the length of the suspension.

The sheriff confirmed that Deputy Matthew A. Vaughn also is facing department internal disciplinary action, but did not say whether that will include a suspension.

Deputy Vaughn was the first responder to the Hallett incident and did not take appropriate action Dec. 1.

No arrest was made that day, when Deputy Hallett, a K-9 handler, was found asleep in his assigned K-9 vehicle. The sheriff said he was not called to the scene that day, nor was he advised of all the circumstances.

“There are certain elements in criminal and traffic cases that police officers have to meet, and those were not met in this case,” the sheriff said. “I took this to the district attorney, and I was told that the only charge I could go with was the open container.”
