PROBATION VIOLATION - MASSENA - Massena-based state police picked up Oatrick J. Kennedy, 30, of 411 Main St., Ogdensburg, on an alleged violation of probation Sunday. He was arraigned by Massena Town Justice Gerald P. Sharlow and sent to the St. Lawrence County Correctional Facility with bail set at $2,500 cash or $5,000 bond.

The warrant had been signed Feb. 13 by Massena Village Justice Eric J. Gustafson after Kennedy failed to appear as directed on the probation violation.

Kennedy had been sentenced to three years probation on Oct. 19, 2010 following his conviction for second-degree criminal contempt. The violated, dated Jan. 24, 2012, alleged since being sentenced to probation Kennedy had been rearrested, failed to report as directed, been discharged from mental health, chemical dependency services and an offender accountability group due to non-compliance with attendance and had admitted smoking marijuana.

The probation department alleged Kennedy had only reported three times between June 1, 2011 and January 2012. They said he had suggested he couldn’t report because he had an infectious disease but had failed to comply with a letter from a physician stating his medical issue and confirming that he was highly contagious.
