Man sentenced to probation over stolen weapon

A former Fort Drum man was sentenced Monday in Jefferson County Court to five years’ probation for trying to sell a stolen firearm in November 2011.

Kenneth J. Dykes, 23, Honea Path, S.C., also was sentenced to an unspecified amount of time served at the Metro-Jefferson Public Safety Building for Jan. 23 guilty pleas to third-degree attempted criminal sale of a firearm and petit larceny. His probation supervision will be transferred to South Carolina.

He entered his pleas using an Alford plea, meaning he did not admit to the underlying facts in the case, but was pleading guilty to avoid the possibility of being convicted of a more serious offense at trial.

He admitted that sometime in November 2011 in the town of LeRay, he tried to trade a .45-caliber pistol that had been reported stolen and that he possessed several rifles that also had been reported stolen.

Mr. Dykes denied knowing the guns, which he obtained from another soldier, had been reported stolen.
