Hogansburg man ordered to pay $12K for worker’s comp benefits earned by injured Massena patrolman


MASSENA — A 21-year-old Hogansburg man has been ordered to make restitution of $12,593.36 to the St. Lawrence County Workers’ Compensation program for payments made to a Massena village patrolman injured during a foot pursuit.

Village Justice Eric J. Gustafson last week also ordered Dustin E. Oakes, 1065 Drum Street Road, to pay a $100 fine and a $50 DNA fee and placed him under probation supervision for three years for his convictions for third-degree assault and resisting arrest.

He allegedly was intoxicated and verbally abusive to police officers outside the Hotel Nadeau bar at 2:22 a.m. Sept. 8 when police were trying to interview him about a fight.

He fled when Patrolman Michael Flynn was attempting to handcuff him. A foot pursuit took place for several hundred yards across Andrews Street down to the bank of the Grasse River near the Massena fire station, where he jumped into the river.

Patrolman Flynn slipped on a ledge on the riverbank, fell down the bank and sprained his shoulder and injured his elbow. He was out of work for several months following the incident because of the injuries he suffered in the fall.

The probation department directed Mr. Oakes to make monthly payments of $350 to the St. Lawrence County Workers’ Compensation program.

Village police, who were assisted by U.S. Border Patrol agents and state police, said Mr. Oakes remained in the river for a time as officers waited for him on the banks. He reportedly came out of the water when rain and lightning started.
