West Carthage ZBA grants variances


WEST CARTHAGE — The village Zoning Board of Appeals granted three variances following a public hearing Wednesday.

Erik Newhouse, 36 High St., was granted an area variance concerning the front-yard setback.

Ronald J. Novak, chairman of the Zoning Board of Appeals, said Mr. Newhouse wanted to move his garage from one side of the property to the other. However, according to code, the structure would be too close to the road. To comply, 40 feet are needed, but there would be only 24 with the move. “There were no complaints from the neighbors, it didn’t change the character of the neighborhood and there were no environmental issues,” Mr. Novak said as to why the variance was granted.

He said most properties in the village are nonconforming lots; thus consideration is taken in granting variances.

Stefano and Mariantonia Magro, 49 N. Jefferson St., were granted an area and use variance to convert a garage into a studio apartment.

Mr. Novak said there is a trailer and garage on the property in question. Even though the garage is only three feet from the sidewalk, it is grandfathered in, having been in place before the enacting of zoning laws. The use variance was granted, according to the ZBA chairman, since Mr. Magro already has spent money to fix up the rental properties and plans to continue to make repairs and improvements.

“He plans to fix up the trailer, which in poor condition,” Mr. Novak said. “There have been no complaints about his actions. The neighbors are probably happy he’s fixing up the property. If not fixed it would probably remain in blight.”

Gary Johnson was granted an area variance to construct a new convenience store at the Valero station, 16 Bridge St.

Mr. Novak said Mr. Johnson plans to demolish the garage next to the current convenience store and create a 2,000-square-foot convenience store.

The enlarged structure would cover more than the permissible percentage of the property and not be set back 40 feet from the neighboring apartment building, but the variance was granted since there was no public objection. Previously neighbors have complained about noise, debris and lights coming from the property; however, Mr. Novak pointed out that the enlarged convenience store will block some of those nuisances.
