Philadelphia man referred to Drug Court for cocaine sale try

A town of Philadelphia man was referred to Jefferson County Drug Court after admitting Thursday in County Court that he tried to sell cocaine.

Gregory J. Hardy-Hall, 21, of 33080 Childs Road, pleaded guilty to third-degree attempted criminal sale of a controlled substance. He had been accused in a grand jury indictment handed up in January of selling the drug in the county in mid-June.

If he successfully completes Drug Court, a substance abuse rehabilitation program designed to serve as an alternative to incarceration, he will have his guilty plea vacated and he will be allowed to enter a guilty plea to the lower level felony of fifth-degree criminal sale of a controlled substance. He would then be sentenced to five years’ probation.

If he is unsuccessful in the program, the conviction will stand and he faces a sentence of 1 years in state prison, followed by an additional year of supervision upon his release.

In other court activity, Bridgette A. McGarvin, 40, formerly of Watertown but now living in Niagara County, successfully completed Drug Court and was allowed to have an August 2011 guilty plea to third-degree criminal sale of a controlled substance vacated and pleaded guilty to fifth-degree criminal possession of a controlled substance. She was subsequently sentenced to an unspecified amount of time served at the Metro-Jefferson Public Safety Building and five years’ probation.

She had been referred to Drug Court in 2011 after admitting she had sold cocaine within the county in May 2011.

Her probation supervision will be transferred to Niagara County.
