NOXIOUS MATERIAL - POTSDAM - Village police picked up Joshua Henderson, 24, of 76 Roosevelt Road, Apt. E, Hogansburg, formerly of Massena and Rochester, on an arrest warrant at 10:35 a.m. Friday and charged him with unlawful possession of noxious matter.

He was arraigned in local court and sent back to the St. Lawrence County Correction Facility with bail set at $500 cash. The charge stemmed from an incident at 12:48 a.m. April 21 at McDuff’s when he was allegedly involved in a verbal altercation with Codi Burke of Haskell Street, Massena. Henderson reportedly pepper sprayed Burke and left the area.

Henderson had been picked up on the warrant Wednesday by Massena Village Police. They had also charged him with third-degree criminal possession of a weapon at that time when police discovered a dagger sticking out from under the seat of his vehicle. He was arraigned on the weapons count Wednesday by Massena Town Justice Gerald P. Sharlow and sent to the county jail with bail set at $10,000 cash or $20,000 bond.

He had been sentenced to time served and fined June 18 when he was sentenced for an attempted criminal conviction in a case that also satsisfied a second pepper spray incident that had occurred in the village of Massena.

Massena Village Police had charged Henderson with possession of a noxious material and fourth-degree criminal mischief following an investigation into a May 24 dispute between Henderson and his former girlfriend, Alanna Cruz. They said Henderson allegedly raised a closed fist before he was pushed away by Ms. Cruz. He then allegedly pepper sprayed her. When Ms. Cruz attempted to file a complaint with police, Henderson reportedly broke her phone.
