Evans Mills man referred to Drug Court for damaging vehicle

An Evans Mills man avoided a potential state prison sentence Thursday in Jefferson County Court by agreeing to participate in a substance abuse treatment program.

Joseph M. Cimineri, 25, of 27943 Rogers Road, pleaded guilty to fourth-degree criminal mischief and was referred to Drug Court.

He had been charged with damaging a vehicle owned by Bernice Clark by kicking and punching it Feb. 15 in the town of LeRay.

If he successfully completes the treatment program that is designed to serve as an alternative to incarceration, he is expected to be sentenced to three years’ probation and be ordered to pay $3,581 in restitution.

If he is unsuccessful, he faces a 2- to 5-year prison sentence, along with the payment of restitution.

In other court activity, Willis T. Baughman, 48, whose last known address was 54381 Otter St., Alexandria Bay, admitted violating probation by being charged with a new crime.

He was charged June 14 by Alexandria Bay police with fourth-degree grand larceny for allegedly stealing more than $1,000 worth of unspecified property May 30 in the village.

The alleged incident occurred the same day he had been sentenced in County Court to three years’ probation in connection with a second-degree trespassing charge stemming from a March or April 2012 entry into Bonnie Castle Marina, Alexandria Bay.

Resentencing on the probation violation was deferred until Aug. 6, at which time there also is expected to be a disposition in the pending grand larceny matter.
