Motorists accused of DWI


The following were charged with driving while intoxicated and related offenses:

n Frank K. Tubolino, 35, of 16905 County Route 66, Sackets Harbor, was charged with aggravated DWI after being stopped while riding an unregistered all-terrain vehicle without a helmet at 1:10 a.m. July 21 on County Route 66. His blood alcohol content was listed at 0.19 percent. A BAC of 0.08 percent or more is considered proof of intoxication under state law. Aggravated DWI is charged when the BAC is 0.18 percent or more.

n Robert H. Johnson, 30, Ogdensburg, also was charged Sunday by state police with operating an ATV while intoxicated and not wearing a helmet. Police said the charges stem from the results of a blood alcohol test conducted after an ATV accident July 18 on Cemetery Road in the town of Lisbon in which the ATV he was driving went through a barbed-wire fence, injuring Mr. Johnson’s neck. The common-law DWI charge was based on the officer’s observation and field tests; police are awaiting the results of a laboratory test to determine Mr. Johnson’s BAC.

n Dana M. Donnelly, 51, East Aurora, also was charged by Jefferson County sheriff’s deputies with failing to keep right following a vehicle stop at 2:27 a.m. July 26 on Route 12 in Alexandria Bay. Her BAC was listed at 0.13 percent.
