Guatemalan man accused of entering U.S. illegally

PITCAIRN — Walter Giron-Vicente, age not available, a citizen of Guatemala, was charged Monday by U.S. Border Patrol agents with re-entry of a deported alien.

According to documents filed Tuesday in U.S. District Court, Syracuse, agents were conducting an immigration checkpoint about 11:45 a.m. on Route 3 when they encountered a vehicle in which Mr. Giron-Vicente was a passenger. He allegedly admitted that he was a Guatemalan national without documents allowing him to be in the United States.

A records check revealed he had been deported from the country in May 2011. He allegedly admitted to agents that he re-entered the United States in December 2011 from Mexico by wading through the Rio Grande near Laredo, Texas. It is claimed he never presented himself for inspection at a designated port of entry.

He waived his right to a detention and preliminary hearing Tuesday and was ordered held in the U.S. Marshal Service’s custody.
