Clinton Street property owners sue Watertown over flood damage


Three Clinton Street property owners have filed suit against the city of Watertown claiming flooding that occurred during the street’s reconstruction caused more than $300,000 in damage to their buildings.

Christa S. Matthews, Lewis G. Spicer III and John Doldo Jr., as trustees of a residual trust under the will of Lewis G. Spicer, filed state Supreme Court action Wednesday at the Jefferson County clerk’s office against the city and the contractor that reconstructed the street, North Country Contractors LLC, Calcium.

The trust owns the Medical Arts Building, 161 Clinton St.; Clinton Court Apartments, 150 Clinton St., and a third building at 171 Clinton St. It is alleged that during the reconstruction in September 2012, water and sewer lines backed up, causing flooding in the buildings. According to the suit, the trust claims there was a total of $343,210 in damage sustained, including $242,460 at Clinton Courts, $74,410 at the Medical Arts building and $26,340 at 171 Clinton St.

The trust claims that workers failed to follow proper procedures for connecting and reconnecting drainage pipes from the properties to the drainage system being built by the city. They also claim the work blocked existing stormwater drainage pipes and prevented water from entering the system, which was under construction as part of a $1.5 million project to rebuild the street between Washington and South Massey streets.

The trust is represented in its action by Watertown attorney Keith B. Caughlin.
