DeKalb Junction man accused of flipping car, charged with DWI


POTSDAM — State police on Tuesday charged David W. Simmons, 20, of DeKalb Junction with aggravated driving while intoxicated following an investigation into a one-vehicle rollover accident on Route 11 in the town of Potsdam.

Troopers said they responded to the accident at 3:20 p.m. and determined Mr. Simmons had allegedly been operating a 2012 gray Chevrolet Impala on Route 11 when he exited the north shoulder of the road and struck a snow bank. The vehicle then overturned onto its roof. Mr. Simmons was not injured. He was also ticketed for speeding.

Troopers said Simmons had a blood alcohol content of 0.27 percent, more than three times the legal limit of 0.08 percent. Under state law, a BAC of 0.08 percent or more is considered proof of intoxication. Aggravated DWI is charged when the BAC is 0.18 percent or higher.

Mr. Simmons is scheduled to appear in Potsdam Town Court on the charges.
