MASSENA — State police on Thursday charged Kody J. Arquette, 22, Akwesasne, with felony aggravated driving while intoxicated, failure to keep right on a two-lane road and drinking alcohol in a motor vehicle.
Troopers said that about 2:30 a.m. on Route 37, they stopped Mr. Arquette for failure to keep right. He submitted to a breath test that determined that his blood alcohol content was 0.20 percent, police said. Under state law, a BAC of 0.08 percent or higher constitutes proof of intoxication. Aggravated DWI is charged when the BAC is 0.18 percent or more.
