MASSENA — State police on Friday charged Dale R. Johnston, 54, of Chateaugay, with a felony count of aggravated driving while intoxicated and reckless driving.
Troopers allege that at 5:59 p.m. on North Raquette River Road, Mr. Johnston made an unsafe lane change following a traffic stop.
Mr. Johnston was issued a ticket for the unsafe lane change. He had a blood alcohol content of 0.20 percent, troopers said.
A blood alcohol content of 0.08 percent or higher is considered proof of intoxication under state law. The charge is elevated to aggravated DWI when the BAC is 0.18 percent or higher.
Mr. Johnston was arraigned and released on his own recognizance. Mr. Johnston, a state Department of Corrections employee with 28 years on the job, was represented at his arraignment by St. Lawrence County Assistant Public Defender Robert Ballan under the county’s counsel at first felony arraignment program.
